Introduction and Acceptance of Terms

Welcome to AffiLink. These Terms of Service ("Terms") govern your access to and use of our affiliate marketing platform, including our website, API, and related services. By creating an account or using our services, you agree to be bound by these Terms. If you do not agree, you may not use our platform.

Description of Service

AffiLink is a performance affiliate platform that connects brands (clients), marketers (influencers), and creators. Our service includes: creating and managing campaigns; generating and sharing affiliate links (affilinks); tracking conversions and attributing them to the correct affiliate; processing commissions and payouts; hosting and delivering content; and managing communities. We provide tools for brands to run campaigns, for affiliates to earn from conversions, and for creators to monetize content.

Account Registration and Responsibilities

You must provide accurate and complete information when registering. You are responsible for maintaining the security of your account credentials and for all activity under your account. You must notify us promptly of any unauthorized access. Different account types (client, influencer, creator) have different capabilities and obligations; you agree to use the platform in accordance with your account type and applicable policies.

Acceptable Use

You agree not to use the platform to:

• Violate any applicable laws or regulations
• Infringe on the intellectual property or privacy rights of others
• Distribute malware, spam, or fraudulent content
• Manipulate conversions, clicks, or attribution in bad faith
• Circumvent platform security, rate limits, or access controls
• Use the service for any purpose that harms AffiLink or third parties

We reserve the right to suspend or terminate accounts that violate these terms.

Intellectual Property

AffiLink and its licensors own all rights in the platform, including software, design, and branding. You retain ownership of content you upload (e.g., images, videos, text). By uploading content, you grant us a non-exclusive, worldwide license to store, display, and deliver that content as necessary to operate the platform. You represent that you have the rights to grant such a license.

Fees, Commissions, and Payouts

Clients fund their wallets to pay commissions. Commissions are calculated based on campaign event rewards and conversion data. Payouts to affiliates are processed according to our accounting cycles and payout statement workflow. Fees, payment terms, and currency handling are described in your account and campaign settings. You are responsible for any taxes arising from your use of the platform. We may change fee structures with reasonable notice.

Termination

You may close your account at any time. We may suspend or terminate your account for breach of these Terms, non-payment, or at our discretion with notice. Upon termination, your right to use the platform ceases. Provisions that by their nature should survive (e.g., intellectual property, limitation of liability, indemnification) will survive termination.

Disclaimers

The platform is provided "as is" and "as available." We do not warrant that the service will be uninterrupted, error-free, or free of harmful components. We disclaim all warranties, express or implied, including merchantability and fitness for a particular purpose. Conversion tracking and attribution depend on third-party integrations (e.g., Shopify); we are not responsible for their accuracy or availability.

Limitation of Liability

To the maximum extent permitted by law, AffiLink and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or goodwill, arising from your use of the platform. Our total liability for any claims related to these Terms or the service shall not exceed the amount you paid us in the twelve months preceding the claim.

Indemnification

You agree to indemnify and hold harmless AffiLink, its affiliates, and their officers, directors, and employees from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the platform, your content, your breach of these Terms, or your violation of any third-party rights.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which AffiLink operates, without regard to conflict of law principles. Any disputes shall be resolved in the courts of that jurisdiction.

Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on our website and updating the "Last updated" date. Your continued use of the platform after changes constitutes acceptance of the revised Terms. If you do not agree, you must stop using the service.
